Terms of Service

Last updated: September 21, 2026

Overview

This website, avaluce.com (the “Site”), is operated by 304 Holdings LLC, doing business as AVALUCE (“we”, “us”, “our”). We offer this Site, including all information, tools and services available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including the additional policies referenced herein (Shipping Policy, Return & Refund Policy, Privacy Policy). If you do not agree to all the terms of this agreement, you may not access the Site or use any Service. Any new features or tools added to the store shall also be subject to these Terms. Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products to you.

1. Online store terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses or any code of a destructive nature. A breach or violation of any of these Terms will result in an immediate termination of your Service.

2. General conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission from us.

3. Products & natural materials

Our lighting is crafted from natural materials such as travertine, marble, alabaster, wood, brass and hand-blown glass. Veining, color and texture vary from piece to piece — these variations are inherent to natural materials and are not defects. We have made every effort to display the colors and images of our products as accurately as possible; we cannot guarantee that your screen’s display of any color will be accurate, and slight differences between the photo and the piece you receive are part of what makes each piece unique. Product offers are valid while stocks last. All descriptions of products and product pricing are subject to change at any time without notice. We reserve the right to limit the quantities of any products offered and to discontinue any product at any time.

4. Prices, taxes & payment

All prices are displayed in U.S. dollars (USD). Prices for our products are subject to change without notice; the price applicable to your order is the one displayed at checkout at the time of purchase. Applicable sales taxes are calculated and displayed at checkout. Payment is processed securely at the time of order through our payment providers; we do not store your card details. We shall not be liable to you or to any third party for any price change, suspension or discontinuance of a product.

5. Accuracy of billing and account information

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update your information so that we can complete your transactions and contact you as needed. We reserve the right to refuse or cancel any order, including orders that appear to be placed by dealers, resellers or distributors, or in cases of suspected fraud or pricing errors. If we cancel an order after payment, you will be refunded in full promptly.

6. Shipping

Shipping areas, costs, processing and delivery times, and transit protection are described in our Shipping Policy, which forms an integral part of these Terms.

7. Returns, refunds & warranty

Returns and refunds are governed by our Return & Refund Policy, including the 30-day home trial and the 2-Year Limited Warranty against manufacturing defects. Nothing in these Terms limits any non-waivable rights you may have under federal law or the laws of your state.

8. Electrical installation & safe use

Hardwired fixtures must be installed in accordance with the National Electrical Code and applicable local electrical codes. If you are not comfortable performing electrical work, we recommend installation by a licensed electrician. Always disconnect power before installation or maintenance. We are not responsible for damage or injury resulting from improper installation, modification or misuse of our products.

9. California Proposition 65

Some products sold on this Site, like many electrical products, may contain chemicals — including in power cords — known to the State of California to cause cancer, birth defects or other reproductive harm. Where applicable, a Proposition 65 notice is provided on the product page. For more information, visit www.p65warnings.ca.gov.

10. Accuracy of Site information

Occasionally there may be information on our Site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information on the Site except as required by law.

11. Optional tools & third-party links

Certain content, products and services available via our Service may include materials from third parties, or links to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites, and we do not warrant and will not have any liability for any third-party materials, websites, products or services. Please review the third party’s policies and practices before you engage in any transaction with them.

12. User comments & submissions

If you send us ideas, suggestions, reviews or other materials (collectively, “comments”), you agree that we may, at any time and without restriction or compensation, use, edit, copy, publish and distribute them in any medium. We are under no obligation to maintain comments in confidence or to respond to them. You agree that your comments will not violate any right of any third party and will not contain unlawful, defamatory or obscene material. You are solely responsible for the accuracy of any comments you make.

13. Intellectual property

All content on this Site — product designs, photographs, texts, logos, graphics and the AVALUCE brand — is the property of 304 Holdings LLC or its licensors and is protected by applicable intellectual property laws. It may not be reproduced, distributed, modified or exploited, in whole or in part, without our prior written permission.

14. Disclaimer of warranties; limitation of liability

Except for the express 2-Year Limited Warranty described in our Return & Refund Policy, the Service and all products are provided “as is” and “as available”. To the fullest extent permitted by law, 304 Holdings LLC, its directors, employees, affiliates and suppliers shall not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Site or the products, including lost profits or data. Our total liability for any claim shall not exceed the amount you paid for the product concerned. Some states do not allow the exclusion or limitation of incidental or consequential damages, so in such states our liability shall be limited to the maximum extent permitted by law. Nothing in these Terms limits rights you have under mandatory consumer protection laws.

15. Indemnification

You agree to indemnify, defend and hold harmless 304 Holdings LLC and its affiliates, officers, agents and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

16. Severability, waiver & entire agreement

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed, without affecting the validity of the remaining provisions. Our failure to exercise or enforce any right or provision shall not constitute a waiver of it. These Terms and the policies referenced herein constitute the entire agreement between you and us regarding the use of the Service, and supersede any prior agreements.

17. Force majeure

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, pandemics, or failures of carriers, suppliers or telecommunications.

18. Governing law & dispute resolution

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict of law principles. Before filing any claim, you agree to first contact us at support@avaluce.com and attempt in good faith to resolve the dispute informally within 30 days. Either party may bring an individual claim in small claims court. Nothing in this section limits any non-waivable rights you may have under the laws of your state of residence.

19. Changes to these Terms

You can review the most current version of the Terms at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates to our Site. It is your responsibility to check this page periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
